Land in industrial zones is regulated and guided on the conditions of identification, issues of land allocation, land leasing with collection of land use fees and other relevant contents, specifically as following:

 

                                                      

Regulations on land in industrial zones

1. Industrial park land includes land for the construction of industrial clusters, industrial zones, export processing zones and other concentrated production and business zones with the same land use regime.

2. The use of land for the construction of industrial parks must be in line with the detailed land use project and detailed land use planning and the detailed planning on construction of industrial zones approved by the competent state agencies. When elaborating detailed planning on construction of industrial parks, it is necessary to be in line with the housing planning and public works serving for laborers living and working in industrial parks.

3. The State allocates land with collection of land use fees or lease of land with annual land rent fees to economic organizations and Vietnamese people residing overseas; For lease land with one-time land payment for the whole lease term or annual payment for overseas Vietnamese and foreign organizations and individuals for investment in infrastructure construction and business of industrial zone.

4. Economic organizations, households and individuals investing in production and business in industrial zones shall be selected the form of land assignment with collection of land use or land lease fees of the State; Sale, lease or sub-lease land attaching to infrastructure of other economic organizations, overseas Vietnamese investing in the construction and business of industrial park infrastructure; Sublease linking with infrastructure of foreign organizations and individuals investing in the construction and trading of industrial park infrastructure.

Overseas Vietnamese who invest in production and business in industrial zones shall be entitled to select the form of land allocation with collection of land use levies or land rents from the State with one-off payment of land rent for the whole period. Rent or pay annual rent; Rent land, sub-lease land attached to infrastructure of economic organizations, other overseas Vietnamese to invest in building and trading industrial park infrastructure; Lease back land associated with infrastructure of foreign organizations and individuals investing in the construction and trading of industrial park infrastructure.

Foreign organizations and individuals investing in production and business in the industrial park shall be entitled to select the form of land lease from the State with lump-sum payment of rent for the whole term of the lease or the payment of annual rent; Renting land or subleasing land associated with infrastructure of economic organizations, Vietnamese residing overseas investing in building and trading industrial park infrastructure; Lease land attached to infrastructure of other foreign organizations and individuals to invest in the construction and trading of industrial park infrastructure.

5. Land users in industrial zones must use the land for the right purposes as determined, being issued a certificate of land use right and other rightshave the rights and obligations in accordance with the provisions of the 2003 Land Law.

In case of assignment of land use right in an industrial zone, the transferee must continue to use the land for the right purpose as determined.

6. Subtenant in industrial parks prior to the effective date of Land Law 2003, have paid the land rental for the whole term of the sublease or prepaid land rent for many years but remaining paid sublease term of 5 years, the economic organization shall have the right on economic organization allocated land by the State with land use fees. For households and individuals having the rights of households and individuals using land which in not leased land.
